For certain vehicles approved on 1 January 2021 or later, Volkswagen AG is legally obligated (under Article 9 of Implementing Regulation EU 2021/392) to collect data on real-world fuel/energy consumption (OBFCM data) together with the vehicle identification number (VIN) and report this annually to the European Commission. The data is used to monitor consistency between test values and real-world vehicle operation values as part of EU requirements.

Registered keepers have the option of refusing to provide this data. In this case, we will refrain from collecting and reporting this data for your vehicle.

Where processing takes place, it is carried out in order to fulfil a legal obligation (Article 6(1)(c) GDPR). This right of refusal is based on the EU regulation stated here and is not the same as the right to object in accordance with Article 21 GDPR.

How do you declare your refusal1?
– Using our online form (recommended) (Euro 7)2
– Through the post (Euro 7)2
– Or through your dealership/Service Partner (Euro 6)2

We will confirm your declaration in writing.

We will process OBFCM data and the VIN exclusively for the aforementioned purposes and only within the required scope.

We will only store the verification of your refusal for as long as is necessary for us to refrain from collecting/reporting data for your vehicle; subsequently, we will erase this verification. Depending on the vehicle and process, data may be collected during a workshop visit or (if technically feasible) via wireless transmission.

1For all-electric VW models, no data relating to actual energy consumption is being reported to the European Commission at the current time in the context of meeting the legal obligation to report in accordance with Article 9 of Implementing Regulation (EU) 2021/392. A refusal is therefore not necessary.
